Terms of Service

1. About ListingRush

ListingRush is a web-based service operated by OceanEdge AS (org. no. 834 944 952), a company registered in Norway. The service lets real estate professionals capture property walkthroughs with a phone and turn them into shareable tours.

By creating an account or using the service you agree to these terms. If you do not agree, do not use the service.

2. Eligibility and account

• You must be at least 18 years old to use the service.
• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• One account per person or organisation unless otherwise agreed in writing.

3. Subscription and payment

Pricing, plans, and credit packages are described in the app and on our pricing page. All fees are charged in advance and are non-refundable for the current billing period. Payments are processed by Stripe. We may suspend access if payment fails. You may cancel at any time; cancellation takes effect at the end of the current paid period.

4. Your content

You retain ownership of all photos, videos, and other content you upload ("Your Content"). By uploading content you grant OceanEdge AS a limited, non-exclusive licence to process and store Your Content solely to deliver the service to you. We do not use Your Content to train models or share it beyond what is required to operate the service.

You are responsible for ensuring you have the right to upload Your Content and that it does not infringe third-party rights or violate applicable law.

5. Acceptable use

You may not use the service to:

• Violate any applicable law or regulation.
• Upload content that infringes intellectual property rights.
• Attempt to reverse-engineer, copy, or scrape the platform.
• Interfere with or disrupt the service or its infrastructure.
• Misrepresent your identity or impersonate others.

Violations may result in immediate suspension or termination without refund.

6. Our intellectual property

All rights in the ListingRush platform, software, and branding belong to OceanEdge AS. Nothing in these terms transfers ownership of our intellectual property to you.

7. AI-generated output

Tours and outputs are provided on an "as is" basis. We do not guarantee dimensional accuracy, completeness, or fitness for any particular regulatory or legal purpose. You are responsible for verifying output before use.

8. Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance. We are not liable for losses caused by downtime.

9. Limitation of liability

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability for direct damages is limited to fees paid in the 12 months preceding the claim.
• Nothing limits liability for death, personal injury, or fraud caused by our negligence.

10. Changes to these terms

We may update these terms with at least 30 days' notice for material changes, delivered by email or in-app notification. Continued use after the effective date constitutes acceptance.

11. Governing law and disputes

These terms are governed by Norwegian law. Disputes shall first be resolved through good-faith negotiation; if unresolved, by Norwegian courts. EU consumers may also use the EU Online Dispute Resolution platform.
